Acceptance of Terms
By accessing or using rowsfire.com (the "Site"), creating an account, or completing a purchase, you ("Customer", "you") confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms") and all referenced policies, including our Shipping Policy, Return Policy, and Privacy Policy.
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. If you are using the Site on behalf of a business, you represent and warrant that you have authority to bind that entity.
We may amend these Terms at any time. Material changes will be reflected on this page with an updated "Effective" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

Definitions
For clarity in this document:

"Rowsfire", "we", "us", "our" — refers to Rowsfire and its operating entity.

"Customer", "you", "your" — refers to anyone visiting, registering on, or purchasing through the Site.

"Products" — refers to flight simulator hardware, accessories, and any other goods offered for sale on the Site.

"Site" — refers to rowsfire.com and any subdomains operated by Rowsfire.

"Order" — refers to a confirmed purchase request from a Customer that has been accepted by Rowsfire.

User Account
For safety and security, each Customer is allowed to create only one registered account by default. Customers attempting to create multiple accounts may have all related accounts suspended without further notice.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at service@rowsfire.com of any unauthorized access.
In accordance with customs regulations, you must provide valid and accurate personal data, including but not limited to name, address, contact, and payment information. In certain countries, the consignee may need to submit ID or passport details for customs clearance or payment verification.
⚠ Important
You are solely responsible for the accuracy of the data you provide. If incorrect information prevents shipment, delivery, or customs clearance, Rowsfire will not be held responsible and will not offer compensation in such cases. As the importer, you are responsible for compliance with all laws and regulations in your country.
We may suspend or terminate accounts at our discretion if we determine, in good faith, that an account has been used in violation of these Terms, applicable law, or for fraudulent activity.

Ordering & Pricing
4.1 Order Acceptance
All product information displayed on the Site constitutes an invitation to treat and not a binding offer. A binding contract is formed only when Rowsfire confirms acceptance of your Order via email and dispatches the Products. We reserve the right to refuse or cancel any Order at our discretion, including (but not limited to) cases of pricing errors, product unavailability, suspected fraud, or violation of these Terms.
4.2 Pricing & Errors
Prices and availability are subject to change without prior notice. While we strive for accuracy in product descriptions, specifications, and pricing, errors may occur. If a pricing or specification error is identified after you place an Order, we will contact you with a corrected offer; you may accept the revised terms or cancel for a full refund.
4.3 Quantity Limits
Given the popularity of certain Products and supply constraints, Rowsfire may limit purchase quantities per Customer or per Order. We reserve the right to modify these limits at any time, including after an Order is placed.
4.4 Taxes & Duties
Quoted prices do not include applicable VAT, import taxes, or duties unless explicitly stated otherwise. For US, UK, and EU shipments, Rowsfire prepays all applicable import duties — see our Shipping Policy for details. For other regions, you are responsible for any local customs charges.
4.5 Risk & Title
Once an Order is dispatched, transportation becomes the responsibility of the third-party logistics carrier. From the point of dispatch, full ownership of the Products transfers to you, and any associated risks during transit are borne by you. Rowsfire's liability for transit damage is governed by Section 12 (Limitation of Liability) and applicable consumer protection laws in your jurisdiction.

Order Cancellation
You may cancel your Order under the following conditions:

Within 5 hours of payment confirmation: full cancellation with full refund, no questions asked. Contact service@rowsfire.com with your Order number.

After 5 hours, before dispatch: contact us as soon as possible. If your Order has not yet entered packing, we will accommodate cancellation at our discretion.

After dispatch: orders cannot be cancelled. Please refer to our Return Policy upon delivery.
Pre-Order and custom-built items: once production begins (typically 5–10 business days after Order), pre-orders cannot be cancelled. We will notify you when production starts; until then, cancellation requests will be honored.

Shipping & Delivery
Detailed shipping methods, timelines, and carrier information are governed by our Shipping Policy, which is incorporated into these Terms by reference. Below are the key contractual provisions:
6.1 Estimated Times
Shipping times displayed on the Site are estimates based on average historical performance and refer to the time from dispatch to estimated delivery. Actual delivery may be impacted by carrier performance, customs processing, weather, holidays, or other events outside our control. Rowsfire cannot be held liable for delays after dispatch but will work in good faith to assist with carrier claims.
6.2 Address Accuracy
You are solely responsible for providing complete and accurate shipping addresses. Rowsfire cannot make changes to shipping addresses once a package has been dispatched, and Rowsfire is not liable for packages lost or returned due to incomplete or inaccurate addresses.
6.3 Refused or Returned Packages
If you refuse a package due to import duties or taxes that you are responsible for, you assume full liability for all costs involved (including return shipping and any restocking fees). Packages reported as "delivered" by carriers are considered delivered; if you believe a delivery is incorrectly marked, please contact us within 7 days of the marked delivery date.
6.4 Restricted Destinations
Due to international trade embargoes and sanctions, we cannot ship to certain countries, including but not limited to: Iran, North Korea, Cuba, Syria, and Sudan. Orders to these destinations will be cancelled and refunded.
6.5 Replacement for Shipping Issues
If your package is verifiably lost or significantly delayed in transit due to carrier error, Rowsfire will arrange a free replacement once a carrier claim is filed and confirmed (typically 14+ days past expected delivery with no tracking progress). If the item is no longer in stock, we will offer a full refund or substitute of equivalent value.

Returns & Warranty
Detailed return procedures are set out in our Return Policy, incorporated by reference. The following are key contractual terms:
7.1 Money-Back Guarantee
You may return Products within 30 days of receipt for a full refund, provided the Products are in original packaging with all accessories, manuals, and packaging materials intact. Refunds are processed within 5 business days of return receipt; bank or payment processor fees and exchange rate fluctuations are not refundable by Rowsfire.
7.2 RMA Required
You must contact us and obtain a Return Merchandise Authorization (RMA) number before sending any item back. Returns received without an RMA number will not be processed.
7.3 Warranty
All new Rowsfire Products carry a 1-year manufacturer warranty covering defects in materials and workmanship under normal use. Warranty does not cover:
- Damage from improper use, modification, or unauthorized repair
- Cosmetic wear from normal usage
- Damage during transit (covered separately under Section 6)
- Issues arising from incompatible third-party software or hardware
7.4 Return Shipping
For non-defective returns, customer pays return shipping. For confirmed manufacturing defects, Rowsfire covers return shipping costs at our discretion using a pre-paid label.
7.5 Non-Returnable Items
The following Products are not eligible for refund and may only be returned for repair under warranty:
- Discounted or end-of-line ("Renewed") Products
- Volume / wholesale Orders
- Customized or made-to-order Products
- Products that have been tampered with or modified by the Customer

Product Descriptions
We make commercially reasonable efforts to ensure that product descriptions, images, and specifications are accurate. However, we do not warrant that all content is error-free, complete, or current. Product images are for illustration; actual products may vary slightly in color or finish due to manufacturing variation.
We reserve the right to correct errors and update content at any time without prior notice. If a key product specification changes after you place an Order or within seven (7) days of delivery, you may cancel and return the Order for a full refund.
Compatibility statements (e.g., support for Fenix A320, PMDG 737) are based on testing at the time of publication. Third-party software updates may affect compatibility. Rowsfire commits to updating Rowsfire App firmware and configuration files in good faith, but we cannot guarantee perpetual compatibility with future versions of third-party software.

Intellectual Property
9.1 Our Rights
All content on the Site — including text, graphics, logos, button icons, images, audio clips, video, digital downloads, software, and source code — is owned by Rowsfire or its licensors and is protected by international copyright, trademark, and other intellectual property laws.
9.2 Limited License
Rowsfire grants you a limited, non-exclusive, non-transferable license to access and personally use the Site. This license does not include:
- Any commercial use of the Site or its contents
- Any collection, use, or aggregation of product listings, descriptions, or pricing
- Any derivative use of the Site or its contents
- Any downloading or copying of account information for the benefit of another merchant
- Any use of data mining, robots, scraping, or similar data extraction tools
The Site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for commercial purposes without express written consent from Rowsfire.
9.3 Third-Party Trademarks
References to Boeing, Airbus, Microsoft Flight Simulator, X-Plane, Fenix, FlyByWire, PMDG, ToLiss, iFly, Garmin, MobiFlight, and other third-party brands are for compatibility identification only. These brands are trademarks of their respective owners, which do not sponsor, authorize, or endorse Rowsfire products.
9.4 User-Generated Content
By submitting reviews, photos, videos, or other content to the Site (including via Judge.me reviews, social media tags, or our Facebook Group), you grant Rowsfire a worldwide, perpetual, royalty-free license to use, reproduce, and display that content for marketing and promotional purposes, with attribution where reasonable.

Marketing Communications
Following registration, Customers may be added to our marketing email list, which features special deals, coupons, promotions, and product news. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email, or by emailing service@rowsfire.com.
For Customers in the European Union, United Kingdom, and other regions with explicit-consent requirements, we will only send marketing communications after you have actively opted in.
Transactional emails (Order confirmations, shipping updates, customer service responses) are not optional and will be sent regardless of marketing preferences, as they are necessary for fulfilling your purchase.

Customer Conduct
We are committed to resolving customer issues professionally and respectfully. We expect the same in return. The following behaviors are not acceptable when communicating with our Customer Service team or in our community spaces (Facebook Group, Discord, etc.):
- Aggressive, abusive, or threatening language, including direct or implied threats on any communication channel
- Personal attacks, sexist, racist, homophobic, or otherwise discriminatory remarks
- Inflammatory statements, profanity directed at staff, or unsubstantiated allegations
- Persistent or vexatious complaints after a matter has been fully addressed in accordance with our published policies
- Demands that staff breach published policies (e.g., refund amount limits, time windows, special compensation outside standard procedures)
- Repeatedly changing the nature or focus of a complaint after a formal response has been provided
If a Customer engages in any of the above, we may:
- Issue a formal notification that the behavior is unacceptable and must cease.
- Suspend further correspondence on the matter if the behavior continues.
- Reserve the right to refuse future Orders from the Customer without further notice.

Limitation of Liability
To the maximum extent permitted by applicable law:
- Rowsfire's total liability arising out of or related to any Order shall not exceed the total amount paid by the Customer for that specific Order.
- Rowsfire shall not be liable for any indirect, incidental, consequential, special, or punitive damages — including but not limited to loss of profits, loss of data, or loss of use — arising from the use of the Site or Products.
- Rowsfire is not liable for damages resulting from improper use, customer negligence, third-party software incompatibility, or any cause not directly attributable to a manufacturing defect.
⚠ Consumer Rights
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable consumer protection laws in your jurisdiction (including but not limited to the EU Consumer Rights Directive, UK Consumer Rights Act 2015, and applicable US state consumer protection laws). If a provision conflicts with such laws, that provision applies only to the extent permitted by law, while the remainder of these Terms remains in effect.

Indemnification
You agree to indemnify, defend, and hold harmless Rowsfire, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms or referenced policies
- Your violation of any law or third-party rights
- Your misuse of the Site or Products
- Your User-Generated Content (reviews, photos, etc.)

Force Majeure
Rowsfire shall not be liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including but not limited to: natural disasters, war, civil unrest, government actions or restrictions, pandemic-related disruptions, supply chain failures, transportation strikes, customs holds, internet or infrastructure outages, and similar events.
During such events, we will make reasonable efforts to communicate impacts proactively and will work in good faith to honor our commitments once the event subsides.

Governing Law & Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Hong Kong SAR], without regard to its conflict of laws principles. Notwithstanding the foregoing, this choice of law shall not deprive you of any mandatory consumer protection rights granted to you by the laws of your country of residence.
15.2 Informal Resolution First
Before pursuing any formal dispute, both parties agree to attempt to resolve any dispute informally by contacting service@rowsfire.com with a written description of the issue. We commit to responding in good faith within 14 days.
15.3 Dispute Resolution
If informal resolution fails, disputes shall be resolved through:

Small claims (under USD $5,000): small claims court in your jurisdiction of residence, or in our principal place of business, at Customer's election.

Larger disputes: binding arbitration administered under the rules of [the Hong Kong International Arbitration Centre (HKIAC)], with arbitration conducted in English.
15.4 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action. This provision does not apply where prohibited by applicable consumer protection laws.

The jurisdiction and arbitration body in this section are placeholders pending Rowsfire's final legal counsel review. The final version will reflect the actual chosen jurisdiction.
16
General Provisions
16.1 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
16.2 No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
16.3 Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to any successor entity without notice.
16.4 Entire Agreement
These Terms, together with the Shipping Policy, Return Policy, and Privacy Policy, constitute the entire agreement between you and Rowsfire regarding the Site and supersede all prior agreements.
16.5 Language
These Terms are written in English. Translations may be provided for convenience, but in case of discrepancy, the English version shall prevail.
16.6 Updates to These Terms
We may revise these Terms periodically. Material changes will be reflected with an updated "Effective" date at the top of this page, and we will notify registered Customers via email when material changes affect their rights or obligations. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
